The significance of context in misleading and deceptive conduct cases

I propose to discuss the role of context in determining whether conduct is misleading and deceptive or likely to mislead or deceive in contravention of what is now provided in s18(1) of the Australian Consumer Law in Sch 2 of the misleadingly renamed Competition and Consumer Act 2010 (Cth) (ACL).
