The significance of context in misleading and deceptive conduct cases

I propose to discuss the role of context in determining whether conduct is misleading and deceptive or likely to mislead or deceive in contravention of what is now provided in s18(1) of the Australian Consumer Law in Sch 2 of the misleadingly renamed Competition and Consumer Act 2010 (Cth) (ACL).

 Sadly, August saw the death of John Stumbles, one of Australia’s leading banking and finance lawyers. The size of the congregation at his funeral in North Sydney on 13th September bore testimony to the tremendous respect and deep affection that John inspired.
