Helping litigators understand experts. How to prepare and examine them

Since 2010, Gene and his colleagues at PF2 have worked on approximately 60 complex litigation matters in the US, UK, Canada and, more recently, Australia. PF2's experts are often hired as testifying experts on financial market cases, but their main role often involves working with counsel in managing technical/statistical evidence. Gene will be speaking about some of his experience overseeing counsels' testifying experts. For the litigators in the audience, he will discuss practices he recommends employing when choosing and preparing your witnesses, and cross examination techniques he believes could be better or more regularly deployed. He will also provide some entertaining 'war stories' that demonstrate themes he comes across with regularity, but wishes he didn't.  He promises not to go into the statistics themselves, but might provide a cheat sheet for sculpting an approach to battle-testing, or examining, statistical evidence produced, even if you're not at all statistically savvy. (There will be a Q&A at the end, but you will also be welcome and encouraged to interrupt proceedings with choice questions. Gene notes that he is accustomed to being cross examined and even heckled -- he recently spent 15 years in New York. So please feel free to prepare challenging questions, or be spontaneous in asking whatever comes to mind.)  



Gene Phillips, Director, PF2 Securities
Gene Phillips is a director at PF2 Securities, a New York-based consulting firm, where he leads the litigation consulting division. Gene is based in Los Angeles. Gene was previously on the buy-side within Citigroup Alternative Investments' Fixed Income Alternatives division in New York. He began his career in the Derivatives group at Moody’s Investors Service. Gene has written extensive research on items ranging from corporate and trust preferred CDOs to leveraged loan covenants, litigation and cultural concerns at financial institutions, and the topic of rating agency reform.  His research and commentary has received numerous press citations in publications such as The Financial Times, New York Times, Wall Street Journal and BusinessWeek. Gene holds a BSc degree in mathematics and applied mathematics, and a BSc Hons degree in the Advanced Mathematics of Financial Derivatives, from the University of the Witwatersrand in South Africa. 

Robert Johnston, Partner, Johnson Winter & Slattery
