Piercing the corporate veil: recent developments in the light of classic cases
Speaker: Associate Professor Lee Aitken

The possibility of 'piercing the corporate veil' provides one method of reaching those operating in the shadow of the company or who use it as a mere puppet. The common law since Saloman v Salman has stressed the juristic independence of the corporation from its promoters, shareholders and directors. In a time of phoenix companies and other abuses of corporate limited liability, should the courts be more active in going behind the corporate form? Recent cases have emphasised the importance of maintaining limited liability.
